Terms and Conditions of Service

1. Introduction

These Terms and Conditions ("Terms") govern the use of the web hosting, domain registration, and related services ("Services") provided by LoveHost ("we," "us," or "our"). By purchasing or using our Services, you ("the Client" or "Customer") agree to be bound by these Terms.

These Terms are designed to ensure the reliability of our network and to protect all customers. As a reseller of 20i Ltd services, our policies mirror the upstream Acceptable Use Policies of our infrastructure provider.

2. Account Setup and Eligibility

We will setup your account after we have received payment and we and/or our payment partner(s) have screened the order(s) in case of fraud. It is your responsibility to provide us with an email address which is not @ the domain(s) you are signing up under.

You must be at least 18 years of age to purchase our Services. We reserve the right to refuse service to anyone at any time for any reason.

3. Content and Acceptable Use Policy (AUP)

All services provided by LoveHost may only be used for lawful purposes. The laws of the United Kingdom and the laws of your residing country apply.

Prohibited Content & Activities include, but are not limited to:

• Illegal Material: Material that infringes on any copyright, trademark, or patent; or is illegal under UK law.
• Spam & Unsolicited Mail: Sending unsolicited bulk email (spam) is strictly prohibited. We maintain a Zero Tolerance policy. Any account found sending spam will be immediately suspended without refund.
• Malicious Code: Distribution of viruses, malware, trojans, worms, or phishing sites.
• Adult Content: Hosting pornography or adult-related content that is illegal or unlicensed is prohibited.
• Hacking/Cracking: Linking to or hosting "warez", cracking tools, or exploits.

4. Resource Usage & Prohibited Scripts

To ensure the stability of the hosting platform for all users, specific resource limits are enforced. You may not:

• Use more than 10% of the platform's processing capacity (CPU) for longer than 90 seconds.
• Run stand-alone, unattended server-side processes or daemons (e.g., IRCD, cron jobs with intervals less than 5 minutes).
• Run any type of web spider, indexer, or bit torrent application/tracker.
• Run any gaming servers (e.g., Minecraft, Counter-Strike).
• Use the hosting as a "file dump" or "cloud storage" for archiving files not directly related to your website (e.g., NextCloud, OwnCloud, Pydio) where the primary purpose is file storage rather than web hosting.

Accounts found to be abusing server resources may be suspended immediately to preserve performance for other tenants.

5. Payment, Renewal, and Refunds

Services are provided on a pre-paid basis. Accounts that are not paid by the due date may be suspended. Use of the service relies on your agreement to pay fees when they are due.

• Renewals: Services automatically renew unless cancelled at least 3 days before the renewal date.
• Refunds: Please refer to our separate Refund Policy.
• Chargebacks: If you initiate a chargeback or dispute with your bank, we reserve the right to immediately terminate all services and report the incident to fraud prevention databases.

6. Backups and Data Loss

While our infrastructure provider (20i) performs courtesy automated system backups, LoveHost does not guarantee the existence, accuracy, or completeness of these backups.

You are solely responsible for maintaining your own backups of your data. LoveHost accepts no liability for any loss of data, regardless of the cause (including hardware failure, human error, or hacking).

7. Domain Names

Domain registration fees are non-refundable. Registration is not guaranteed until you receive confirmation that the domain has been successfully registered.

By registering a .UK domain, you also agree to Nominet's Terms and Conditions. By registering other TLDs (like .com), you agree to ICANN's policies.

8. Limitation of Liability & Indemnification

LoveHost shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from our servers going off-line or being unavailable for any reason whatsoever.

Indemnification: You agree to indemnify and hold harmless LoveHost, its owners, and its infrastructure providers from any claims resulting from the use of our service which damages you or any other party.

9. Termination

We reserve the right to terminate your account without notice if you violate these Terms. If your account is terminated due to a violation of the AUP (e.g., spamming or hosting illegal content), no refund will be provided.
